Art Lease Agreement

By selecting a lease option, you agree to the following terms:

This agreement applies only to the individual or entity completing the lease transaction and is not transferable.

1. Lease Duration

Artwork is leased for the selected term:

  • 3 months
  • 6 months
  • 12 months

The lease period begins from the delivery date.

2. Payment Terms

  • Lease payments are billed monthly and must remain current throughout the lease period.
  • Customers must maintain a valid payment method for all recurring or invoiced payments.
  • Payments unresolved beyond 15 days may result in lease termination and return of the artwork.
  • A deposit may be required and is refundable upon return in good condition.
  • Billing issues must be reported within 5 days.
  • If the artwork is purchased during the lease, a portion of lease payments may be applied toward the purchase price, as agreed.
  • Lease continues until artwork is returned or purchased

3. Delivery, Installation & Return

  • Local delivery may be available; otherwise, artwork is shipped in a protective wooden crate.
  • Original packaging must be retained for the duration of the lease.
  • If the customer arranges transport, Preethi Arts is not responsible for transit damage.
  • Installation is not included; safe display is the customer’s responsibility.
  • Return or pickup will be coordinated at lease end. Shipping and handling costs are the customer’s responsibility unless otherwise agreed.
  • Artwork must be returned in original packaging; otherwise, the customer is responsible for transit damage up to the full value.

4. Care, Insurance & Liability

  • Artwork must be displayed indoors in a clean, dry, climate-controlled space.
  • Avoid sunlight, heat, moisture, smoke, and unstable surfaces.
  • The artwork may not be relocated, altered, or modified without approval.
  • The customer is responsible for any damage, loss, or theft beyond normal wear, up to the full value of the artwork.
  • Commercial use may require insurance. Proof of insurance may be requested where applicable.
  • Preethi Arts reserves the right to inspect the artwork during the lease term with reasonable notice.

5. Promotion & Use

  • The artwork may not be resold, subleased, or transferred to any third party.
  • Residential use is permitted. Commercial, staging, or public display use must be disclosed at the time of leasing and may require prior approval.
  • If featured in photos or media, credit must be given:

  • The artwork may not be reproduced, edited, or used for merchandise without prior written permission.

6. Purchase Option

  • The leased artwork can be purchased at any time.
  • A portion of lease payments may be applied toward the purchase price, based on terms agreed at the time of lease.

7. Exchanges

  • Exchanges are not available during the lease term.
  • A new artwork may be selected after the lease is completed.

8. Usage & Availability

  • The lease may not be transferred, reassigned, or used by any third party without prior written approval.
  • Each artwork is unique and available for lease on a first-come basis.
  • Once leased, the artwork may not be available until it is returned.

9. Termination & Return

  • Artwork must be returned in original condition and packaging at lease end.
  • Early termination may be requested in writing and may include applicable charges.
    Fees paid are non-refundable.
  • Failure to return within 7 days may result in additional charges up to the full value.
  • Damage beyond normal wear may result in repair or replacement costs up to full value.
  • If the artwork is not returned at the end of the lease term and no extension is agreed, the lease may continue on a monthly basis or the customer may be required to complete the purchase of the artwork, at the discretion of Preethi Arts.

Lease Continuation:

At the end of the initial lease term, the lease will continue on a month-to-month basis unless the artwork is returned or purchased.

Preethi Arts may periodically review long-term leases and may offer options to purchase or conclude the lease.

10. Cancellation

  • Leases cannot be canceled before the minimum term is completed.
  • Early returns may still require payment for the full agreed lease period.

11. Copyright & Reproduction

  • All artworks remain the intellectual property of Preethi Arts and are protected under U.S. copyright law.
  • Copyright is not transferred with the lease or possession of the artwork.
  • The artwork may not be reproduced, copied, or used for commercial purposes without permission.
  • Photographs of the artwork are permitted with proper credit when used publicly.
  • Unauthorized use may result in claims for damages.
  • The artwork signatures must remain visible and unaltered.

12. Liability for Breach

  • Failure to comply may result in lease termination and applicable charges.
  • The customer is responsible for any losses due to damage, misuse, or breach, up to the full value of the artwork.
  • Preethi Arts reserves the right to recover the artwork or seek compensation where necessary.
  • Any unauthorized reproduction, alteration, or misuse of the artwork may result in immediate termination of the lease and further action as permitted by law.
  • The customer is responsible for reasonable recovery or enforcement costs.
  • The customer agrees to indemnify Preethi Arts against third-party claims arising from misuse.

13. Agreement Acknowledgment

By proceeding with a lease request or payment, you confirm that you have read and agree to these terms.
